FYB Terms & Conditions

This Privacy Policy and Client Consent Agreement (“Agreement”) governs your access and use of the website www.feelyourbest.co, mobile applications, and digital services operated by Feel Your Best Wellbeing Private Limited (“FYB”, “We”, “Our”, “Us”), incorporated under the laws of India with its registered office at #17, 2nd Floor, 7th Main Road, II Stage, Indiranagar, Bangalore North – 560038, Karnataka.

By creating an account, booking services, or otherwise using FYB’s Platform, you acknowledge and consent to the terms of this Agreement. Your acceptance is digitally recorded with a date and time stamp, and operates as a binding legal contract between you and FYB.

1. DEFINITIONS

• "Platform" means FYB’s website being www.fyb.care, mobile applications, and digital services through FYB connects Users with independent third-party professionals for providing wellness activities detailed in Clause 2

• “Third Party Professionals” include but are not limited to therapists, coaches, nutritionists, and fitness experts provide wellness activities detailed in Clause 2.

• "User Data" means any information, including personal/ medical/ sensitive personal data, provided by the User while using FYB’s Platform to FYB and third party professionals.

2. SERVICES OFFERED BY FYB

The User acknowledges and agrees that:

• FYB is merely a technology-enabled platform that facilitates access to wellness services by connecting Users with independent third-party professionals, including but not limited to therapists, coaches, nutritionists, and fitness experts  for providing the following curated blend of wellness activities, including but not limited to:

  • Mental health therapy

  • Nutrition and wellness guidance

  • Fitness and movement programs

  • Sleep and mindfulness coaching

  • Peer and community support

  • Digital tools and tracking resources

• FYB connects Users to the experts and resources, tailored to individual needs, and measured by real progress, not just participation

• All wellness activities are designed to complement, not replace, medical treatment. Users should consult medical professionals as needed.

• The Experts are independent service providers and are not employees, agents, representatives, or partners of FYB. FYB does not supervise, control, or guarantee the services provided by such Experts, nor does FYB make any representations or warranties regarding the qualifications, suitability, or effectiveness of any Expert.

• The User understands that FYB’s role is limited to facilitating connections between Users and Experts, and FYB shall not be responsible or liable for any acts, omissions, advice, or services provided by the Experts.

• All engagements and interactions between Users and Experts are at the sole risk and discretion of the User, and FYB disclaims all liability arising therefrom and User agrees to indemnify, defend, and hold harmless FYB, its founders, team members, advisors, and affiliates against any claims, losses, liabilities, or damages arising therefrom

3. YOUR OBLIGATIONS

• User undertakes to provide accurate, honest information throughout service use
• User undertakes to use FYB’s platform in a lawful manner and only for personal wellness purposes.
• User undertakes to maintain confidentiality of login credentials and report any unauthorized access
• User undertakes to deal with or avail services of third party professional only through the platform of FYB and shall not avail services of third party professional outside the platform of FYB, regardless whether the third party professional is presently providing or was in past provided wellness services on the platform of FYB.
• User understands that FYB is an integrative well-being platform and not a substitute for medical diagnosis or emergency care

4. PRIVACY POLICY OF FYB

This explains how FYB collects, uses and stores your data when you use our platform.

• Information FYB Collects

• Personal Information: When you sign up for FYB, we may collect:

(i) Name, email address, contact details

(ii) Date of birth, gender, location

(iii) Health and wellness information (as voluntarily shared)

(iv) Goals, preferences, and progress data

(v) Payment information (via secure third-party processors)

• Sensitive Personal Data/ Medical Data: 

FYB may process Sensitive Personal Data or Information, including:

(i) Mental health status

(ii) Medical history (if shared voluntarily)

(iii) Lifestyle habits (e.g., sleep, diet, exercise patterns)

• Usage Data

  • Device information, browser type, IP address

  • Session activity, engagement metrics, cookies

• How We Use Your Information

Your data helps us provide a personalized, integrative wellness journey, including:

(i) Matching you with suitable experts (therapists, coaches, nutritionists)

(ii) Delivering tailored wellness plans and tracking progress

(iii) Providing User Support and responding to queries

(iv) Improving services, features, and user experience

Sending essential communications, updates, and wellness tips​

• Data Sharing and Third Parties

FYB does not sell and/ or share your personal data.
We may share data only with Third Party Professionals on the platform including Wellness experts and coaches to deliver wellness activities

All third-party professionals on the platform are contractually obligated to handle your data with care and confidentiality.

5. FORCE MAJEURE AND CYBERSECURITY

FYB shall not be liable for any delay, disruption, or failure to perform due to reasons beyond its control, including but not limited to:

• Natural disasters, pandemics, acts of war, or government restrictions

• Cybersecurity incidents such as hacking, ransomware attacks, data breaches, or denial-of-service attacks

6. INDEMNITY

The User agrees to indemnify, defend, and hold harmless FYB, its founders, team members, advisors, and affiliates against any claims, losses, liabilities, or damages arising from:

• Breach of this Agreement by the User

• Any unauthorized access or cyber incidents including hacking of the website of FYB or data storage facility of FYB affecting User Data whereby the User Data is compromised

• Any breach of terms and conditions of the contract between FYB and third party professional including unauthorised sale or sharing of User Data with world by third party professionals

• Any unauthorized access or cyber incidents including hacking of the computer or storage facility or storage device of third party professionals used by third party professionals to store User data

• Any injury suffered by the User pursuant to or by following the wellness activity/ activities provided by third party professional on the platform to the User

7. ARBITRATION CLAUSE

• Any dispute, difference, or question arising between FYB and the Users ("You" or "Your" or "Yourself" or "User") in connection with this Agreement or its interpretation, performance, breach, termination, or any matter arising out of or relating to this Agreement (including any claim for damages or compensation), shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.

• The arbitration shall be conducted as follows:

(i) Arbitral Tribunal:
The arbitral tribunal shall consist of a sole arbitrator mutually appointed by the parties. If the parties are unable to agree upon a sole arbitrator within 30 (thirty) days of the receipt of a written notice from either party to the other party invoking arbitration, the appointment shall be made in accordance with the provisions of the Arbitration and Conciliation Act, 1996.

(ii) Seat and Venue of Arbitration:
The seat of arbitration shall be Bengaluru, and the venue of the arbitration shall be Bengaluru.

(iii) Language:
The language of the arbitration shall be English.

(iv) Governing Law:
The arbitration proceedings and this Agreement shall be governed by and construed in accordance with the laws of India.
